KONA - Terms of Service

These Terms of Service (“Terms”) govern your use of the KONA mobile application and related services (collectively, the “App” or “KONA”). By downloading, accessing, or using KONA, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Purpose of the App
KONA is a triathlon training and coaching support app that provides training plans, analytics, and related functionality for endurance sports. The App is intended for informational and educational purposes only and does not provide medical, diagnostic, or professional healthcare advice.

2. Eligibility
You may only use KONA if:
• You are at least 18 years old, and
• You have the legal capacity to enter into a binding contract under applicable law.
By using the App, you represent and warrant that these conditions are met.

3. Accounts & Registration
To use KONA, you may need to create an account or sign in via third-party providers (e.g., Apple, Google).
You agree to:
• Provide accurate, current, and complete information.
• Keep your login credentials confidential and secure.
• Be responsible for all activities that occur under your account.
If you suspect unauthorized access, you must notify us immediately at support@trainkona.com.

4. Subscriptions, Free Trials & Billing
4.1. Subscription Plans
KONA may offer different subscription options (e.g., monthly, yearly, lifetime) (each a “Subscription”). Prices, features, and durations are shown in the App and in the App Store listing. All billing, renewals, and payment processing are handled by Apple (App Store), not directly by KONA.
4.2. Free Trial
We may offer a free trial period (e.g., 14 days). After the trial ends, your Subscription will automatically convert to a paid Subscription and the applicable fee will be charged unless you cancel in time via your App Store account.
You are responsible for managing and cancelling your Subscription before the trial ends if you do not wish to continue.
4.3. Auto-Renewal & Cancellation
Unless cancelled at least 24 hours before the end of the current period, your Subscription will automatically renew and your App Store account will be charged for the next period.
To cancel or manage your Subscription, go to:
Settings → Apple ID → Subscriptions or
https://apps.apple.com/account/subscriptions
Cancelling a Subscription will stop future charges but does not automatically entitle you to a refund for already charged periods.
4.4. Refunds
The App Store is solely responsible for handling refund requests. We do not process or control refunds directly. Any refund decisions are made by Apple according to their policies.

5. Use of the App & Health Disclaimer
You understand and agree that:
• KONA does not provide medical advice, diagnosis, or treatment.
• KONA is not a substitute for consultation with a doctor, physiotherapist, or other qualified healthcare professional.
• Training for endurance sports (e.g., triathlons, marathons, Ironman events) involves significant physical stress and risk of injury or health complications.
Before starting or modifying any training plan, you should:
• Consult a qualified doctor or healthcare professional, and
• Ensure you are medically cleared for intense endurance training.
By using KONA, you acknowledge that you do so at your own risk and are responsible for your own health, training choices, and performance.

6. Third-Party Integrations (e.g., Garmin)
KONA may integrate with third-party services such as Garmin Connect, Apple Health, or other platforms (collectively, “Third-Party Services”).
By connecting a Third-Party Service, you authorize KONA to:
• Access and process data made available by that service (e.g., activity data, training metrics, sleep and recovery data, heart rate information, etc.), and
• Use such data to provide and improve training plans, analytics, and app features.
You can disconnect such integrations at any time via the App or the Third-Party Service. Use of Third-Party Services is governed by their own terms and privacy policies; KONA is not responsible for their content, availability, or actions.

7. Intellectual Property
All content within the App, including but not limited to training plans, algorithms, text, graphics, logos, icons, images, UI elements, and software, is owned by or licensed to KONA and is protected by copyright, trademark, and other intellectual property laws.
Subject to your compliance with these Terms, KONA grants you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use.
You may not:
• Copy, modify, distribute, sell, lease, or sublicense the App or any part of it.
• Reverse engineer, decompile, or attempt to derive the source code.
• Use the content or algorithms for developing a competing service.

8. Acceptable Use & User Conduct
When using KONA, you agree not to:
• Use the App for unlawful, harmful, or abusive purposes.
• Upload or share content that is illegal, defamatory, discriminatory, or otherwise inappropriate.
• Interfere with the security or operation of the App.
• Attempt to gain unauthorized access to any systems or accounts.
We may suspend or terminate your access if you violate these Terms or use the App in a manner that we reasonably believe is harmful.

9. No Guarantee of Results
Training plans, recommendations, and analytics in KONA are based on general principles and data inputs and are not guaranteed to produce specific results (e.g., race times, placements, or performance improvements).
Your progress and results depend on numerous factors outside of our control, including your health, consistency, recovery, sleep, nutrition, stress levels, and environmental conditions.

10. Disclaimers
KONA is provided on an “as is” and “as available” basis.
To the fullest extent permitted by law, we:
• Do not warrant that the App will be uninterrupted, error-free, or secure.
• Do not warrant that the information, training suggestions, or data presented are complete, accurate, or suitable for your individual needs.
You are solely responsible for your use of the App and your decisions regarding training and competition.

11. Limitation of Liability
To the maximum extent permitted by law, KONA (and its owner, employees, contractors, and partners) shall not be liable for any:
• Indirect, incidental, special, or consequential damages, or
• Loss of profits, data, or goodwill, or
• Injuries, health consequences, or damages arising from your training, racing, or use of the App,
even if we have been advised of the possibility of such damages.
In any event, our total liability arising out of or relating to the App or these Terms shall be limited to the amount you have paid for the App or services during the 12 months immediately preceding the event giving rise to the claim.
Some jurisdictions do not allow certain limitations of liability; in such cases, these limitations apply only to the extent permitted by applicable law.

12. Changes to the App & Service
We may update, modify, or discontinue parts of the App at any time, including features, training content, or subscription offerings.
We may also update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and may notify you via the App or email. Your continued use of KONA after such changes constitutes acceptance of the updated Terms.

13. Termination
You may stop using KONA at any time and can delete your account within the App or by contacting us.
We may suspend or terminate your access to KONA if:
• You violate these Terms,
• You misuse the App or abuse other users, or
• We are required to do so by law or regulatory obligations.
Upon termination, you lose access to the App and any non-downloaded data stored within it. Termination does not affect any rights or obligations that by their nature should survive (e.g., payment obligations, limitations of liability).

14. Governing Law & Jurisdiction
These Terms are governed by the laws of Germany, without regard to its conflict of law principles.
If you are a business user, any disputes shall be subject to the exclusive jurisdiction of the courts in Munich, Germany. If you are a consumer, mandatory consumer protection rules and jurisdiction rules of your country of residence may additionally apply.
